Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Pingsir. By creating an account or using the service, you agree to these Terms. Please read them carefully.

1. Acceptance of Terms

By registering for or using Pingsir, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using Pingsir on behalf of a business, you confirm that you have the authority to bind that business to these Terms.

2. Description of Service

Pingsir is a WhatsApp Business messaging platform that lets businesses send broadcasts, manage conversations through a shared inbox, organise contacts, create message templates, and view analytics. Pingsir operates on top of the official WhatsApp Cloud API. You connect your own Meta WhatsApp Business Account (WABA) to use the service.

3. Account Registration

You must provide accurate and complete information when creating an account and keep it up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately of any unauthorised use.

4. Payment & Credits

Pingsir charges a monthly platform fee based on your chosen plan. Messaging is billed on a pre-paid credit basis: you load credits, and message charges are deducted from your balance. Message charges reflect Meta's per-conversation pricing plus a small Pingsir platform markup.

Plan fees are billed in advance and are non-refundable except where required by law. Upgrades take effect immediately; downgrades take effect at the end of your current billing period.

5. Acceptable Use

You agree not to use Pingsir to send spam, unsolicited cold outreach, or any content that is unlawful, misleading, harassing, or harmful. You must obtain valid opt-in consent from contacts before messaging them and must honour opt-out requests promptly.

We may suspend or restrict accounts that violate these rules or that put our platform, other users, or the WhatsApp ecosystem at risk.

6. WhatsApp Policy Compliance

Your use of Pingsir is also subject to Meta's WhatsApp Business Terms, the WhatsApp Business Messaging Policy, and the WhatsApp Commerce Policy. You are responsible for complying with these policies. Violations may result in restrictions imposed by Meta on your WABA, which are outside Pingsir's control.

7. Intellectual Property

Pingsir, including its software, design, and branding, is owned by Pingsir and protected by applicable intellectual property laws. You retain ownership of your own content, contacts, and message data. You grant us a limited licence to process this data solely to provide the service.

8. Termination

You may cancel your account at any time from your billing settings. We may suspend or terminate your access if you breach these Terms, fail to pay fees, or misuse the service. On termination, your right to use Pingsir ends, and we will handle your data in accordance with our Privacy Policy.

9. Limitation of Liability

Pingsir is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, Pingsir is not liable for any indirect, incidental, or consequential damages, or for message delivery failures, delays, or restrictions caused by Meta or WhatsApp. Our total liability is limited to the fees you paid in the three months preceding the claim.

10. Governing Law

These Terms are governed by the laws of India. Any disputes arising from these Terms or your use of Pingsir are subject to the exclusive jurisdiction of the courts of India.
